Short Update: Further changes in the Hungarian criminal procedure due to COVID-19

FT Admin - May 22, 2020 - COVID-19 Updates, Access to Justice

On 31 March 2020, the Hungarian Government issued a decree that overrode certain provisions of the Hungarian Code of Criminal Procedure given the state of danger declared by the Government due to the COVID-19 pandemic.  Further amendments followed on 8 May after the adoption of Government Decree 188/2020. (V. 7.). These further amendments concern e.g. the following areas of the Hungarian criminal procedure: 

  • presence at procedural acts, 
  •   access to case files, 
  •  the public nature of trials, 
  •  the possibility to issue penal orders, 
  •  suspension of procedures.
